Q.- My doctor is restructuring his practice and is now charging a flat concierge fee in order to see him.  Can this fee be reimbursed from my health FSA?

A.- Probably not.  A retainer or concierge fee is typically not reimbursable from an FSA because it is similar to an insurance premium payable whether or not medical care is provided. However, if the doctor can separately allocate the fee attributable to the actual medical services, a portion of the concierge fee could potentially be an eligible expense.   

You should contact your physician to see if he or she would be able to separately allocate a portion of the fees to medical expenses.  The physician may or may not be able/willing to do so.  If the physician identifies the cost of the medical expenses and if those expenses are actually incurred, they could be eligible for reimbursement from the FSA.
