Q. -  We just hired our 20th employee last week. Does that mean we have to start offering COBRA right away?

A.  No. A plan is not subject to COBRA for any calendar year if the employer employed fewer than 20 employees on a typical business day during the preceding calendar year.  You should keep track of your employee count this year to determine if you will have to offer COBRA next year.
