Deadline to Object to EEO-1 Data Disclosure

The Equal Employment Opportunity Commission requires all private sector employers with 100 or more employees and federal contractors with 50 or more employees to submit demographic workforce data by race/ethnicity, sex and job categories. Employers meet this obligation by submitting an EEO-1 Component 1 Data Report through an EEOC web portal.

A Component 2 Data Report is pay data that some employers must file as part of their EEO-1 report, identifying pay by gender, race and job category. Many employers have objected to the requirement of identifying pay data, and the OFCCP allowed contractors to submit written objections to the Component 2 Data Report. Recently, the OFCCP announced that they are extending the deadline for employers to submit objections to the disclosure requirement until October 19, 2022.

Employers who wish to challenge collection and disclosure of pay data should make sure to do so before October 19.
