FLSA Overtime Calculator Advisor

The Fair Labor Standards Act (FLSA) requires covered, nonexempt employees to be paid at least the federal minimum wage for each hour worked and to be paid overtime pay at one and one-half times regular rate of pay for hours worked over 40 in a workweek.

The Department of Labor provides an Overtime Calculator Advisor intended to help employers understand overtime requirements by calculating overtime for a sample pay period. The Overtime Calculator Advisor may be accessed by clicking here.

The tool provides background information on overtime requirements and then takes the employer through a series of questions. It provides a sample overtime pay calculation based on information provided. To use the Advisor, the employer should have a sample of pay records and corresponding hours worked available.

The employer is asked for information about the frequency of pay, hours worked, rates of pay and additional compensation. No personally identifiable information is collected.

Employers may wish to review the Advisor and confirm that their calculation of overtime for employees in consistent with Department of Labor requirements.
