White House Pushes for National Data Breach Legislation

In a report on data and privacy published last week, the White House recommends the adoption of a national data breach reporting standard. This recommendation comes as current technologies allow for the collection of an increasing amount of personal information and the potential consequences of data breaches grow more severe.

Presently, a majority of states follow their own laws governing how consumers should be notified in the event of a data breach involving their personally identifiable information. The report calls on Congress to legislate a single standard in accordance with the Administration’s May 2011 Cybersecurity legislative proposal, which seeks to clarify and standardize the existing state laws. The recommended standard would define notification time periods and reduce interference with legal investigations. It might also emphasize notification of more serious breaches over those that are less damaging.
