Q.- One of our employees was just appointed legal guardian of his 16 year old brother. Does this allow him to enroll his brother in our health coverage?

A.- You should review the terms of your plan (or contact your insurance company) to find out if the health plan extends dependent eligibility to a child for whom an employee is a legal guardian. A plan wouldn’t have to cover a child in a guardianship relationship but it very well might allow coverage. If plan allows the coverage, becoming a guardian should be a permissible mid-year event to add the individual as the employee’s dependent child.
