Q.- We terminated our 2021 health plans as of 1/1/2022 and now offer a new plan with a new insurer for our active employees. Do our COBRA continuants have the right to enroll in the new plan, or is their COBRA over since we ended the plan that they had when they terminated employment?

A.- Your COBRA continuants should have the right to coverage under the new plan just like your similarly situated active employees. COBRA qualified beneficiaries would have the right to COBRA continuation coverage on the plan with the new insurer (if they elect and pay for coverage).
