Q.- We started our business this year and we already have 35 employees. Our first employee resigned. Do we offer him COBRA coverage?

A.- An employer is subject to federal COBRA if it has 20 or more employees on business days during the prior year. Since your business did not exist last year, it would not be subject to federal COBRA for its first year.
