Q.- A former employee is continuing coverage under COBRA due to termination of employment. The individual is disabled according to the Social Security Administration and is terminating COBRA coverage to go on Medicare. Can his spouse stay on COBRA? 

A.- Yes. Assuming the spouse was a COBRA qualified beneficiary (was enrolled in the health plan at the time of the qualifying event), the spouse may continue COBRA coverage. The maximum period of the spouse’s COBRA coverage should be extended to 29 months due to the former employee’s disability.
