Q.- We are re-hiring an employee who was offered and elected COBRA. When he is rehired, he will once again be eligible for health coverage. He asked if he could continue his COBRA instead of enrolling in active coverage because his parent is paying the COBRA premium. Is this allowed?

A.- If you are subject to federal COBRA, yes. Eligibility for COBRA is cut off if an individual enrolls in other health coverage, but mere eligibility for other health coverage does not end a person’s right to continue coverage under COBRA.
