Q.- We have an employee who works two jobs. He contributes to the health FSA of his other employer, and he asked if he can contribute to our health FSA. He is eligible for the plan. Is he allowed to participate in both and what amount may he contribute?

A.- If your company is not affiliated or part of a controlled group with the other company, the employee may contribute to each health FSA, up to the IRS limit (assuming each plan allows contributions up to the limit). That means in 2019, he can contribute up to $2,700 to your health FSA and contribution up to $2,700 to the other employer’s health FSA. He should be reminded that he cannot be reimbursed for the same expense from two different plans, so he should make sure he has enough separate expenses to cover his contributions.
