Q.- An employee terminated employment after receiving workers’ compensation.  As part of the settlement, we all agreed that there would be no COBRA right.  Do we have to do anything?

A.  First, it is questionable if you can negotiate away a COBRA right in a settlement agreement.  Second, if COBRA is not being offered, the individual must receive notification as to the unavailability of COBRA coverage.
