An employee who believes he or she has been discriminated against at work based on race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40 or older), disability or genetic information must file a charge of discrimination with the U.S. Equal Employment Opportunity Commission (EEOC) before filing a job discrimination lawsuit against an employer. A charge of discrimination is a signed statement alleging that an employer engaged in employment discrimination and a request for the EEOC to take action.

The EEOC launched a new public portal that individuals can use to report potential employment discrimination claims and request a charge of discrimination. The public portal allows employees of private employers to submit requests for intake interviews directly to the EEOC after answering a series of questions about the potential claim. After the intake is completed online, the person bringing the charge will still have to complete an in-person interview at a local EEOC office.

If the EEOC approves the charge, the employee bringing the claim will be able to sign and file the formal charge online, through the portal. The portal is available to update information, upload documentation and receive messages from the EEOC.
