EEOC Delays EEO-1 Compliance Date

The Equal Employment Opportunity Commission (EEOC) announced a delay in the date for submitting 2019 EEO-1 data due to the COVID-19 pandemic. In 2019, the reporting deadline was May 31.

Each year, the EEOC surveys employers to collect demographic information about employees. The EEO-1 is an annual reporting requirement for private employers with 100 or more employees and federal government contractors or first-tier subcontractors with 50 or more employees and a federal contract, subcontract or purchase order of $50,000 or more.  Covered employers are required to report employee data by ethnicity, race and sex. Reporting is typically completed through the EEOC website using a prescribed data collection form.

The EEOC recognized that employers may have issues organizing and submitting data due to workplace complexities resulting from the COVID-19 National Emergency. Therefore, the EEOC has extended the 2019 reporting deadline to March 2021 when data for both 2019 and 2020 will be required to be filed. The EEOC has not extended the VETS-4212 filing deadline.
