Updated Voluntary Self-Identification of Disability Form

The U.S. Office of Federal Contracts Compliance Programs (OFCCP) updated the Voluntary Self-Identification of Disability Form. The Voluntary Self-Identification of Disability Form is a document used by employers to collect information about the disability status of their employees or job applicants. The updates provide new language for describing disabilities and provide additional examples. Federal contractors and subcontractors must begin using the form by July 25, 2023.

Under Section 503 of the Rehabilitation Act of 1973, federal contractors, and subcontractors with contracts of $10,000 or more are required to take affirmative action to employ and advance qualified individuals with disabilities. The Voluntary Self-Identification of Disability Form is one of the tools employers use to fulfill this obligation.

The form is voluntary, meaning individuals are not required to disclose their disability status. However, providing the information can assist employers in tracking and analyzing their efforts to recruit, hire, promote, and retain individuals with disabilities. It helps employers evaluate the effectiveness of their affirmative action programs and identify areas where they can improve diversity and inclusion.

The form includes a series of questions related to disability status, allowing individuals to indicate whether they have a disability or choose not to disclose their disability status. The information provided on the form is confidential and should be kept separate from personnel records.

The Voluntary Self-Identification of Disability Form is primarily applicable to employers who are federal contractors or subcontractors, as defined by the regulations of the OFCCP. Private employers who are not federal contractors may choose to collect disability-related information, but they are not mandated to do so under federal regulations.
