Q.- Is the COBRA election due date back to where it was before COVID? The National Emergency is over but we have some people on our COBRA reports who have passed their 60 day election period.
A.- The tolling of COBRA timeframes will not extend beyond July 10, 2023. On this date, COBRA timeframes revert back to pre-pandemic rules. For individuals with a COBRA qualifying event between May 12, 2022 and July 10, 2023, the last day of the continuant’s election period is 60 days after July 10, 2023 which is September 8, 2023. An individual who has a COBRA qualifying event on or after July 10, 2023 will have 60 days from the date of the event (or the date the COBRA notice is mailed, if later) to elect COBRA coverage.
