Q.- Can we charge our employees a fee for participating in our health FSA plan?

A.- Maybe, but consider how you will have employees pay the fee. The fee may not be considered a medical expense eligible for reimbursement from the FSA itself. The participation fee may also not be considered an eligible cafeteria plan expense for pre-tax payment. Consult with your tax advisor if you are considering charging a fee for FSA plan participation.
