Q.- Can we offer a health flexible spending account plan to only executive employees?

A.- While you might be able to limit eligibility for your FSA to a specific class of employees, you should be mindful of the nondiscrimination rules for FSA plans. It is likely that your executives are highly paid in relation to the rest of your workforce and this may cause your FSA to fail nondiscrimination testing.
