Q.- A former employee’s active coverage ended with us in June 2021. He did not elect COBRA coverage in the election period which ended in August because he started coverage with another employer. His coverage with the second employer is ending and he is being offered COBRA by them. The former employee reached out to me and asked if he could elect COBRA now under our plan instead of his second employer’s plan. I know the election period has been extended- does he have the right to enroll in our plan?

A.- He might have the right to enroll in your plan but it will not get him the coverage he is seeking. If he elects COBRA under your plan, he can have coverage back to his loss of coverage date (June). He will have to pay, but his COBRA eligibility with you will end when he became covered under his new employer plan. So, if he is looking to be covered under COBRA today, he should elect COBRA under his second employer’s plan.
