Q.- Do we have to offer COBRA to an employee who we know is moving overseas?  She won’t be able to use our health coverage since we only offer HMOs.

A.- Yes, if the employee was covered under the health plan on the day before her qualifying event.  Just because you know the coverage won’t be useful to her does not give you the opportunity to refuse the COBRA election.
