Q.- An employee’s daughter is taking weight training at a gym after school.  She wants to be reimbursed from her Dependent Day Care FSA for the cost of the class since it is held while she is at work.  Is this an eligible expense?

A.- No.  Weight training classes are not “care” eligible for reimbursement from a Dependent Day Care FSA.

To be eligible for reimbursement, an expense must be incurred so the employee can work and the expense must be for the care of a qualifying individual.  Expenses are not employment-related just because they are incurred while a person is working.  The expenses must enable the person to be employed.

Expenses are for care if their primary function is to ensure the well-being and protection of the child.  If the expense is primarily for a non-care purposes (such as exercise or music lessons), the expense is not eligible for reimbursement.

Expenses incurred to learn a particular skill are considered educational and not for care, even if the employee would have had to obtain care for the child during the time period.
