Q.- Should we be sending our COBRA notices by certified mail, return receipt requested?

A.- No. The COBRA rules state that required COBRA notifications must be sent by First Class mail. It is not advisable to send notices by certified mail, return receipt requested because the intended recipient could reject delivery and the employer would not have complied with its notification obligations under the COBRA rules. If you use Cobra Control Services for your COBRA administration, CCS sends qualifying event letters by first class mail, with proof of mailing by batch confirmation. BAS also provides administrators with access to a copy of each qualifying event letter sent.
