Q.- Can an employee terminate a Dependent Day Care FSA election if the dependent meets the eligibility requirements, but no longer attends day care?

A.- Maybe, depending on the terms of the employer’s plan. No longer attending day care could be considered a significant change in coverage which would allow a mid-year election change.
