Q.- We employ 15 employees in the US, but employ an additional 40 employees in Europe. Are we subject to Federal COBRA or state mini-COBRA?
A.- You would be subject to Federal COBRA. Federal COBRA applies to employers with 20 or more employees. Employees outside of the United States are counted in determining the number of employees for reaching the 20 employee threshold.
