Nondiscrimination Rules Changed for ACA

The government has finalized updates to Section 1557 of the Affordable Care Act (ACA), focusing on enhancing and reinstating nondiscrimination policies. This effort, supported by the National Health Law Program (NHeLP), aims to eliminate healthcare discrimination and ensure equitable access to medical services.

The revised regulations increase protections across several key areas:

  • Language Access and Racial Equality: The updates mandate healthcare providers to offer language assistance to individuals with limited English proficiency, ensuring they understand health information and services. This measure helps overcome linguistic barriers and prohibits racial discrimination in healthcare settings, promoting better access for people of color.
  • Protections Against Sex Discrimination: The changes clarify and reinforce the prohibition of sex discrimination within healthcare. This includes unfair treatment based on sex stereotypes, gender identity, sexual orientation, and pregnancy-related conditions.
  • LGBTQI+ Rights: The revised Section 1557 also safeguards LGBTQI+ individuals from discrimination in healthcare, specifically addressing the needs related to gender-affirming care and hormonal treatments.
  • Accessibility for People with Disabilities: The new regulations ensure that healthcare facilities and services are accessible to people with disabilities. This includes physical accessibility, effective communication, and non-discriminatory pricing practices such as co-pays and coverage limits. The rules aim to prevent exclusionary insurance practices and ensure community integration and equitable treatment for disabled individuals.
