Q.- We just completed a dependent audit and found several dependents who were wrongly enrolled in our health coverage. When we remove the dependents, do we have to offer them COBRA coverage?
A.- If they are being removed because they don’t meet the definition of dependent under your health plan, that alone is not a COBRA qualifying event which would require a COBRA election. However, if you are removing a dependent child when they age out of the health plan or removing a spouse due to divorce, those could be COBRA qualifying events requiring an offer of COBRA continuation coverage.
