Newly Married Spouse Reimbursement

Q: An employee just got married. Can he be reimbursed from his health FSA for an expense he paid for his spouse before they were married?

A: No. A health FSA can reimburse expenses for the employee and his eligible dependents. The determination of dependent would be when the expense was incurred, not when the amount was paid or submitted for reimbursement.
