Will You Be Subject to Health Care Reform This Year?

This year, large employers must provide their employees with health coverage or pay a penalty. It is important to know if you are a large employer for Affordable Care Act purposes.

Under health care reform, a “large” employer subject to the pay-or-play penalty is an employer with 50 or more full-time equivalent employees. Employers with more than 50 full-time and full-time equivalent employees should carefully review their workforce to determine if they need to offer coverage that is affordable and provides minimum value. 

In determining the number of full-time equivalent employees, the employer must consider all employees in its controlled group. Seasonal employees who work less than 120 days during the year are not considered in the head count, but those who work 120 or more days are.
