According to multiple news sources, the United States Senate’s latest effort to repeal and replace the Affordable Care Act is stalled. The Better Care Reconciliation Act (refer to our prior article by clicking here) does not have enough votes to pass. Moreover, it has been reported that the U.S. Senate does not have enough votes to pass a procedural motion to simply repeal the Affordable Care Act without replacement.
After meeting with the President Wednesday, reports indicate that the Senate will vote next week to open debate on health care reform. It is unclear which bill will be brought for discussion.
With the difficulties of Congress' attempt to reform the nation’s health care system, the ACA remains the law of the land. Employers with 50 or more full-time employees should continue to offer affordable coverage to their full-time employees that provides minimum value. Such employers should also make sure to be prepared for the annual IRS Form 1094/1095 reporting requirements.
