Q.- We are a religious organization. Do we have to count hours and send an Affordable Care Act 1095 Form to our religious employees?

A.- A religious worker who has taken a vow of poverty does not need to have hours counted for determining full-time status. That means the individual will not need a 1095 form just due to being a full-time employee. For this rule to apply, the worker must be a member of the religious order, must have taken a vow of poverty, and must be performing tasks that are usually required of active members of the order. If the individual is covered under a health plan, the insurer of the health plan (or your organization if self-funded), must provide the individual a 1095 form documenting the coverage.
