Q.- One of our employees wants to enroll in the dependent care FSA now. She said she didn’t enroll because her mom was watching her children, and now she is going to send them to day care. Do we let her in the plan mid-year?
A.- Probably not. It is our understanding that under IRS rules, needing dependent care coverage mid-year is not an event which would allow a mid-year enrollment in a dependent care FSA. We suggest that you consult your legal counsel before allowing the participant to enroll in the FSA outside of the open enrollment period.
