Nondiscrimination Postings for Covered Entities

The Affordable Care Act is more than just IRS Form 1094/1095 reporting.  The ACA places requirements on health plans and their offers of coverage.  One of those requirements is that covered entities must follow nondiscrimination rules.  These rules apply to health plans and healthcare providers.

Beginning October 16, 2016, covered entities must post new nondiscrimination statements and taglines.  The Notice of Nondiscrimination states:

  • The covered entity does not discriminate on the basis of race, color, national origin, sex, age or disability in its health programs and activities;
  • The covered entity provides appropriate auxiliary aids and services, including interpreters for individuals with disabilities and information in alternate formats;
  • The covered entity provides language assistance services, including translated documents and oral interpretation, free of charge and in a timely manner, when such services are necessary to provide meaningful access to individuals with limited English proficiency;
  • How to obtain the services;
  • Identification of and contact information for the employee responsible for coordinating compliance (if the covered entity has 15 or more employees);
  • The grievance procedure (if the covered entity has 15 or more employees); and
  • How to file a discrimination complaint with the Office for Civil Rights.

In addition to the new Notice, covered entities must post a “tagline” informing people that language assistance services are available free of charge.  The tagline must be written in at least the top 15 languages spoken by individuals with limited English proficiency in the applicable state.
