Federal Contractors Must Certify Affirmative Action Plans

Starting in 2022, federal contractors who must maintain an affirmative action program (AAP) will be required to certify to the government compliance with their annual AAP requirements.

Government contractors holding a contract of $50,000 or more who employ 50 or more employees must develop and maintain an AAP.

The Department of Labor’s Office of Federal Contract Compliance Programs created a new “Affirmative Action Program Verification Interface” through which federal contractors will certify that they have developed and maintained appropriate Affirmative Action Programs. The portal will include a way to securely upload a copy of the contractor’s AAP.

Covered federal contractors and subcontractors may register on the portal starting February 1, 2022. The certification features will be active beginning March 31, 2022. Existing federal contractors must make their certifications by June 30, 2022.
