EEOC Component 2 Pay Data Notice

The U.S. Department of Labor Office of Federal Contract Compliance Programs published a Notice reversing a previous administration’s decision to forego the collection of EEO-1 Component 2 data.

The EEOC collected employee compensation data from certain employers with more than 100 employees during the 2017 and 2018 EEO-1 reporting years. The compensation data report, referred to as “Component 2 data,” included W-2 compensation and average hours worked for employees. This information was collected in addition to standard demographic data.

The EEOC stopped the Component 2 data collection in 2019 announcing in a notice that it did not expect the data to provide significant utility. Now, the EEOC has withdrawn that notice saying that the 2019 announcement was premature. The new notice commits the EEOC to once again evaluate the utility of Component 2 data to determine if its collection should be reinstated.
