Q.- My company is an S corporation and I share ownership of the company with my brother. May I participate in our company's flexible spending account plan?

A.- No. Self employed individuals may not participate in an FSA. A more-than 2% shareholder of an S corporation is considered a self-employed individual. General partners in a general or limited partnership also cannot participate in an FSA.
