Q.- An employee is turning 65. Do we have to give him or his wife a COBRA notice?

A.- No, unless he (or his wife) would lose coverage under your group health plan. If your business has 20 or more employees, your health plan is subject to Medicare's Secondary Payer rules. These rules prohibit your plan from automatically terminating an active employee from health coverage when the employee reaches age 65 and becomes eligible for Medicare. Assuming the employee does not lose coverage under your plan at age 65, there is no COBRA qualifying event.
