COBRA Questions & Answers Support Services

BAS’ COBRA Q&A Services entitles the client to guidance on up to 6 COBRA or mini-COBRA-related questions per month, with carry-over of unused questions to the following month, for a total maximum of 72 inquiries per year. 

We advise on COBRA compliance not related to any litigation, including, but not limited to:

  • When COBRA continuation coverage must be offered, who must receive COBRA continuation coverage and duration of coverage
  • The coordination between COBRA and Medicare
  • COBRA in mergers and acquisitions
  • Preferred COBRA action when employee is fired for misconduct
  • Coordination of COBRA with FSAs, HRAs and HSAs
  • Review of COBRA administrative Processes
  • As-needed COBRA benefits support

The COBRA rules require specific notices to be distributed to employees and COBRA qualified beneficiaries upon certain events.  BAS can prepare, review and/or revise required COBRA notifications.  BAS can also assist with written responses to participants’ COBRA inquiries – See On-Demand COBRA Notice Drafting below.

General HR Q&A (No COBRA Support)

BAS’ General HR Q&A Services entitles the client to guidance on up to 6 HR-related questions per month, with carry-over of unused questions to the following month, for a total maximum of 72 inquiries per year. For insurance agencies/brokerages, we offer a volume package of 30 Inquiries per month with an annual contract option only.

We advise on human resources compliance issues not related to any litigation, including, but not limited to:

  • FSA/HRA/HSA compliance issues
  • Health plan benefit structures after health care reform
  • Wellness program implementation and operation
  • HIPAA compliance
  • FMLA, disability, vacation and other leave issues

HIPAA Training

Employers sponsoring group health plans subject to the HIPAA privacy and security rules must provide training to that portion of the workforce that handles Protected Health Information under HIPAA. BAS’ compliance team can work with your organization to provide the required HIPAA training for your employees.  Our expert staff can tailor a HIPAA training program to meet your individual policies and procedures, or can provide generalized training for basic HIPAA compliance purposes. Training can be provided on-site or through our convenient web-based presentation tools.

QMCSO

Group health plans subject to ERISA must have procedures in place to evaluate and administer medical child support orders.  A state court or government agency can require an ERISA-covered health plan to provide health benefits to children of a divorced employee by issuing a medical child support order.  These procedures must be distributed upon request and upon receipt of an order.

BAS’ QMCSO Procedure and Review Service can provide procedures tailored to your health plan for both QMCSOs and National Medical Support Orders.  BAS can evaluate orders on your behalf and provide required notifications, all in accordance with established time frames.  BAS’ assumption of this required procedure on behalf of your plan will save you time and money on training personnel in the rules required to evaluate and implement orders.  Policy preparation, along with review of orders are offered.

SPD & SMM

Employers are required to document their health and welfare plans, along with their plans for providing benefits on a pre-tax basis under section 125 of the Internal Revenue Code.

BAS’s SPD and SMM Service offers employers a cost-effective way for documenting their health plan benefits.  BAS can prepare a wrap summary plan description incorporating your provider’s description of plan benefits, contracts and other materials.  BAS can also prepare and distribute the yearly required Summary of Material Modification supplement to summary plan descriptions.

BAS’s service provides the option of documenting flexible spending account plans within the wrap-SPD document.  Separate pricing is provided depending on plan structure and needed documentation.

Annual Form 5500s & SARs

BAS’ Form 5500 Preparation Service offers ERISA-covered employers an easy and efficient means for completing their annual Form 5500 filing obligations for their health and welfare plan.  BAS can prepare the reporting document, organizing schedules
provided by your plan’s various benefit providers.  BAS has the interface with the government agencies necessary for on-line preparation, and will forward to you a final form for your submission.

BAS can also prepare, on your behalf, the required Summary Annual Report that must be distributed annually to plan participants.

Employee Notices & Distribution

Group health plans have several reporting and disclosure obligations under various federal laws, including ERISA, the Internal Revenue Code, CHIP, HIPAA, etc.  Employers have an obligation to make certain they comply with all required notice obligations or in some cases face penalties.

BAS’ Health Plan Notice and Communications Service can assist employers meet their required obligations on notices and disclosures to plan participants, beneficiaries and certain other individuals.  To help employers meet their notice obligations, BAS can prepare and distribute notices required under
