Updated FMLA Forms

The U.S. Department of Labor issued new forms for employers to use when authorizing leave under the Family and Medical Leave Act (FMLA). The new forms replace the DOL’s model documents which expired in February. 

The main change in the FMLA documentation is reference to the Genetic Information Nondiscrimination Act (GINA). GINA prohibits employers from asking or requiring genetic information of an employee or family member, except in limited circumstances. 

Employers should review their FMLA documentation and make sure they incorporate reference to GINA as identified in the new model notices and medical certification templates. Changes are effective immediately and may be used through May 31, 2018.
